By accessing or using Go Aria (the "Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you may not use the Service.

2. Service Description

Go Aria is an AI-powered receptionist platform that answers inbound calls and SMS messages, captures leads, and schedules appointments on behalf of local businesses. The Service is provided on an as-is basis to help businesses automate customer communication.

3. Use Restrictions

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Impersonate another person or entity.
• Engage in fraudulent, deceptive, or unlawful conduct.
• Send spam, harassment, or abusive communications.
• Reverse engineer, decode, or extract the AI models or underlying technology (except where prohibited law permits).
• Interfere with or disrupt the Service or its infrastructure.
• Use the Service for healthcare, legal, or financial advice (advisory only).

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account. We are not liable for losses resulting from unauthorized access if you fail to report promptly.

5. Payment and Billing

All pricing is in USD and billed monthly unless otherwise stated. By subscribing, you authorize us to charge your payment method. You agree to keep your payment information current.

• Setup Fee: One-time, non-refundable setup fee applies to new accounts.
• Monthly Billing: Charges recur on your billing date each month.
• Cancellation: You may cancel your subscription at any time. No refunds for partial months.
• 30-Day Money-Back Guarantee: If you cancel within 30 days of signup, we will refund recurring monthly charges (excluding setup fee).
• Late Payment: If payment fails, we may suspend your account until payment is received.

6. Intellectual Property

Go Aria retains all rights to the Service, its technology, AI models, and content ("Intellectual Property"). You receive a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes. You may not copy, modify, distribute, or create derivative works without our consent.

You retain ownership of data you provide (customer names, business information), but grant us a license to process, analyze, and use such data to improve the Service (in anonymized form).

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. GO ARIA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not guarantee the accuracy, completeness, or quality of AI responses. You use the Service at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO ARIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Go Aria from any claims, damages, or costs arising from your use of the Service, your data, your violation of these Terms, or your violation of any third-party rights (including IP rights, privacy, and regulatory compliance).

10. Acceptable Use and Compliance

You are responsible for ensuring your use of Go Aria complies with all applicable laws, including TCPA regulations (US telemarketing), GDPR (EU), CASL (Canada), and local regulations. You must obtain proper consent before using the Service to contact customers. Go Aria is not liable for your compliance violations.

11. Suspension and Termination

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a security risk. Upon termination, your access to the Service ends immediately, but your obligation to pay outstanding charges continues.

You may terminate your account at any time by requesting cancellation through your dashboard or by contacting support. Termination is effective at the end of your current billing cycle.

12. Third-Party Services

Go Aria integrates with third-party services (Telnyx, Retell AI, Cal.com, Anthropic). These services are governed by their own terms and privacy policies. Go Aria is not responsible for third-party services, their availability, security, or compliance.

13. Modifications to Terms

We may update these Terms from time to time. Changes become effective 30 days after posting. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or prominent notice on the Service.

14. Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Northern Virginia, unless prohibited by law. You waive the right to jury trial and class action.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
